Disputes about property ownership can be some of the most stressful and emotionally charged legal problems people face. They often arise after a relationship breaks down, but they can just as easily involve siblings, friends, business partners or anyone who has contributed to a property without being properly recognised on the legal title.

These disputes are usually dealt with under the Trusts of Land and Appointment of Trustees Act 1996 — commonly known as TOLATA. 

With over 25 years’ experience in family, property and civil litigation, including representing clients in court, negotiating settlements and resolving co-ownership disputes, I regularly advise clients on their rights and options under TOLATA.

  1. What is a TOLATA claim?

A TOLATA claim is a legal action used to resolve disputes about the ownership or sale of a property. It is commonly used when:

  1. Two people own a property together but disagree about what should happen to it
  2. Someone has contributed financially but is not on the legal title
  3. One person wants to sell the property and the other refuses
  4. An ex-partner claims a share of a home they lived in
  5. A family member or friend contributed to a purchase or renovation and wants their interest recognised

TOLATA gives the court the power to:

  • determine who owns what share
  • order the sale of a property
  • decide whether someone has a beneficial interest
  • resolve disputes about occupation or exclusion
  1. When do TOLATA disputes arise?

Although many people associate these claims with cohabiting couples, they can arise in a wide range of situations, including:

  1. Former partners who bought a home together or where one contributed financially
  2. Parents who helped a child buy a property and later fall into dispute
  3. Siblings who inherited a property but disagree about selling it
  4. Friends or investors who purchased a property jointly
  5. People who contributed to renovations or mortgage payments without formal recognition

The key issue is usually whether someone has a beneficial interest — a legal right to a share of the property, even if their name is not on the deeds.

  1. How does the court decide who owns what?

The court looks at a range of factors, including:

  1. Legal title — whose name is on the deeds
  2. Financial contributions — deposits, mortgage payments, renovations
  3. Agreements or understandings — written, verbal or implied
  4. Conduct — how the parties behaved and what they intended
  5. Evidence of shared ownership — emails, messages, bank transfers, discussions

The court’s job is to determine what the parties intended, even if nothing was written down. This is why early legal advice is essential.

  3. Allowing one party to buy out the other
  4. Deciding whether someone has a beneficial interest

    Important note during current covid-19 pandemic:

    Usually, you can meet Kuldeep’s main office is in London, near Blackfriars station. Kuldeep works largely as a consultant with Sterling Law, based there, where he is the most experienced solicitor. However, having said the above, due to the current emergency coronavirus issue, we are confining meetings to remote/virtual consultations by phone or Skype / video-con at present.

    You can have a consultation at short notice, and in the evening and at weekends. Just get in touch and we will see what we can do. Documents can, of course, also be exchanged by email.

    • call us on the number above. Kuldeep will try to answer whenever he is free, even out of hours. We recognise that our clients sometimes need help urgently and we always try to help at short notice if possible.
    • Fill in the Enquiry form on this page. The more information that you give about the nature and background of your problem, the more useful information we can give in reply. Kuldeep always does his utmost to call back ASAP.

    Fees

    What do I have to pay and what are your fees?

    We never charge anything without expressly agreeing it with you in advance. But all our substantive work comes at a cost, and we can give you an outline of what your case may cost in an initial chat, which will be free-of-charge.

    We may be able to quote a fixed fee, or give an hourly rate, with an estimate of total likely costs.
